1. Acceptance of Terms

By accessing or using any services provided by Tow Master Toronto ("Company", "we", "us", "our"), including but not limited to towing, roadside assistance, vehicle recovery, and scrap car removal, you ("Customer", "you", "your") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Service Description

Tow Master Toronto provides professional towing, roadside assistance, vehicle recovery, and scrap car removal services throughout the Greater Toronto Area (GTA). Services are available 24 hours a day, 7 days a week, 365 days a year. Response times are estimates and not guaranteed, as they depend on traffic conditions, weather, and other unforeseen circumstances.

3. Service Requests

Service requests can be made by phone at (416) 829-2921 or via WhatsApp at https://wa.me/14168292921. When requesting service, you must provide accurate information including your exact location, vehicle make and model, and the nature of the issue. The Company reserves the right to refuse service at its sole discretion.

4. Pricing and Payment

Prices for services are provided upfront before dispatch. All prices are in Canadian Dollars (CAD) and do not include applicable taxes unless stated otherwise. Payment is due upon completion of service unless other arrangements have been made in writing. We accept cash, debit, and all major credit cards. Additional fees may apply for:

  • Long-distance tows exceeding base mileage
  • After-hours or holiday service (though we are 24/7, standard rates apply)
  • Specialized equipment for complex recoveries
  • Wait time exceeding 15 minutes at pickup location
  • Toll road fees or parking charges incurred during service

5. Cancellation Policy

If you cancel a service request after a truck has been dispatched, a cancellation fee may apply. This fee covers the time and fuel costs incurred. The cancellation fee is typically $25-50 depending on distance traveled. If our driver arrives at the location and is unable to locate you or the vehicle after reasonable attempts, the full service fee may be charged.

6. Liability and Disclaimer

The Company exercises reasonable care in transporting your vehicle. However, we are not responsible for:

  • Pre-existing damage to your vehicle (documented by our pre-tow inspection photos)
  • Mechanical failures that occur before, during, or after towing unrelated to our service
  • Items left inside the vehicle – ensure you remove all personal belongings before towing
  • Damage caused by road conditions, weather, or third parties after delivery
  • Consequential damages, loss of income, or rental car costs

Our maximum liability for any claim is limited to the amount paid for the specific service provided. We recommend that you review your insurance policy, as coverage for towing-related damages may be provided by your insurer.

7. Vehicle Inspection and Documentation

Before towing, our technician will conduct a visual inspection of your vehicle and document its condition with photos. By accepting our service, you acknowledge that this inspection is for damage prevention purposes and that any pre-existing damage noted (or not noted) is your responsibility. You are encouraged to review the inspection photos before we depart.

8. Scrap Car Removal Terms

For scrap car removal services:

  • You must provide valid ownership (vehicle permit) to complete the transfer
  • We reserve the right to adjust the quoted price if the vehicle condition differs from described
  • Payment is made in cash upon pickup unless other arrangements are made
  • The vehicle becomes our property upon payment and signed transfer of ownership
  • All personal belongings must be removed before pickup; we are not responsible for items left in vehicles

9. Roadside Assistance Limitations

Our roadside assistance services include battery jump-starts, flat tire changes, fuel delivery, and lockout recovery. These services are provided on a best-effort basis. We cannot guarantee that every vehicle can be jump-started or lockout can be resolved without damage. If we are unable to resolve the issue on-site, we will offer towing services at the standard rate.

10. Customer Responsibilities

You agree to:

  • Provide accurate and complete information when requesting service
  • Be present at the pickup location or designate an authorized representative
  • Secure all personal belongings and valuable items before towing
  • Ensure the vehicle is accessible (e.g., not blocked in, underground access granted)
  • Pay all applicable fees promptly upon completion of service
  • Provide ownership documentation for scrap vehicle transactions

11. Underground Parking and Tight Access

Our fleet includes low-clearance vehicles designed for underground parking access. However, if your vehicle is in a location with height restrictions below 6'6", you must notify our dispatcher before dispatch. We reserve the right to refuse service or charge additional fees if the access is significantly more challenging than described.

12. Long Distance Towing

For long-distance towing (over 50 km), a deposit may be required before dispatch. Estimated delivery times are provided in good faith but are not guaranteed due to traffic, weather, and vehicle considerations. The customer is responsible for any parking, storage, or access fees at the destination.

13. Privacy Policy

Your use of our services is also governed by our Privacy Policy. We collect personal information including your name, phone number, address, and location for service delivery purposes. We do not sell or share your information with third parties except as necessary to provide services or as required by law.

14. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these terms or our services shall be resolved through binding arbitration in Toronto, Ontario, unless the claim is within small claims court jurisdiction. You agree to waive any right to participate in a class-action lawsuit against the Company.

15. Modifications to Terms

We reserve the right to modify these Terms of Service at any time without prior notice. Changes become effective immediately upon posting to our website. Your continued use of our services after any changes indicates your acceptance of the modified terms.
